Advertising Terms & Conditions

In these terms and conditions:

"You" and "Your" refers to the person or business who places the advertisement; 

"We" and "Our" refers to DogMog Limited; and 

"the DogMog Website" means this website, www.dogmog.co.nz. 

Advertiser's Warranties

In submitting your advertisement for publication on the DogMog Wesbite, you warrant that the advertisement:

• Does not, and is not likely to, mislead or deceive or otherwise breach the Fair Trading Act 1986;
• Does not infringe the intellectual property rights of any third party;
• Is not defamatory or otherwise contrary to reasonable public standards; and
• Does not breach any statute, regulation, by-law or other rule or law, including without limitation the Advertising Codes of Practice issued by the Advertising Standards Authority.

You agree to indemnify DogMog, its employees, servants, and agents against all losses or costs (legal or otherwise), liabilities, claims or proceedings whatsoever arising as a result of any breach of the warranties set out above including, without limitation, costs incurred by us in correcting or amending advertisements to ensure compliance with our terms and conditions.

No warranty

Except as expressly provided, we make no warranties of any kind, whether express or implied including any implied warranty of merchantability or fitness for purpose. We shall not be liable to you or any third party for any loss, cost, damage or expense, including, without limitation, for any technical malfunction, computer error, loss of data or disruption of any kind other than as a result of DogMog's negligence.
We make no warranty that any information provided in an advertisement is free of error or reliable.

Consumer Guarantees Act 1993

The guarantees contained in The Consumer Guarantees Act 1993 are excluded where you acquire, or hold yourself out as acquiring, goods or services from us for business purposes. 

Placement of advertisements

The positioning or placement of advertisements on the DogMog Website is at our discretion except:

• In relation to directory listings, which are positioned according to business rating (or alphabetically where no rating exists); and /or
• Where specifically agreed in writing.

Errors/Omissions

You must contact as soon as possible if there is an error or omission in any advertisement you place. We will then use reasonable endeavours to remedy the error/omission, but shall not be liable for any direct or consequential loss, except where the loss is attributable to our error, in which case our liability will be limited to the cost of placing the advertisement.

Withdrawal of advertisements

We reserve the right to reject any advertisement or to rescind any advertisement without having to give a reason for doing so.

Rates and Cancellation

Advertising rates will be as set out in the current DogMog pricing list, available from us on request. We may amend those rates at any time without notice.
If you wish to cancel your advertisement, you must contact us prior to the agreed booking deadline. 

GST

Advertising placed by advertisers who are not New Zealand residents will be zero-rated for GST purposes. GST will be applied at the standard rate to New Zealand-based advertisers.

Payment

You will be invoiced in respect of any advertisement you place with us. Invoices must be paid by the 20th day of the month following the date of issue of the invoice.
